CSW Fabrications - Installation Terms and Conditions

These Installation Terms and Conditions (the "Installation Terms") apply to all installation services provided by CSW Fabrications ("CSW Fabrications," "we," "us," or "our") for products including, but not limited to, Glass Balconies, Glass Floors, and Privacy Screens (the "Products"). By agreeing to proceed with our installation services, you (the "Customer") agree to be bound by these Installation Terms, which form part of our overall Terms and Conditions of sale.

1. Site Preparation - Customer Responsibilities

It is the sole responsibility of the Customer to ensure that the installation site is adequately prepared prior to the scheduled installation date. This includes, but is not limited to:

  • Clearance of Obstructions: The area immediately surrounding the installation location must be completely clear of any obstructions, including but not limited to:

    • Vehicles

    • Furniture

    • Plants, trees, or shrubs

    • Building materials

    • Rubbish or debris

    • Any other items that may impede access or the installation process.

  • Clear Access Routes: Safe and unobstructed access routes to the installation area must be provided for our installation team and equipment. This includes ensuring pathways, doorways, and any necessary access points are free from obstacles.

2. Site Condition Following Survey

  • Adherence to Survey Conditions: The installation site must be in precisely the same condition as it was at the time of the initial site survey conducted by CSW Fabrications. The survey is the basis upon which the Products were designed and manufactured, and the installation plan was formulated.

  • Post-Survey Alterations: Any alterations, modifications, or changes made to the installation site after the date of the survey and prior to our return for installation are the sole responsibility of the Customer.

  • Impact of Alterations: If, upon our arrival for installation, we find that alterations have been made to the site that:

    • Cause a delay in the commencement or completion of the installation.

    • Require adjustments or alterations to the manufactured Products to ensure a safe and correct installation.

Full payment will be required for the current installation costs. Charges will also be added for the alteration of products (as outlined in Section 3).

3. Charges for Delays and Product Alterations Due to Site Changes

In the event that post-survey alterations to the installation site necessitate delays or alterations to the Products, the Customer will be liable for the following charges:

  • Delayed Installation Costs: All costs incurred by CSW Fabrications as a result of the installation being delayed due to site alterations will be fully chargeable to the Customer at the agreed rate. This includes, but is not limited to, labour costs, transportation costs, and any other associated expenses.

  • Product Alteration Costs: Any costs associated with altering or remanufacturing the Products due to changes in the installation site after the survey will be fully chargeable to the Customer. This includes the cost of materials, manufacturing labour, and any design modifications required.

  • Additional Installation Visit Cost: Should a return visit be required to complete the installation due to site alterations not being rectified prior to our initial visit, the Customer will be charged an additional installation fee at the original rates to cover the costs of the subsequent visit.

4. Structural Stability of the Building

  • Customer Responsibility: It is the Customer's responsibility to ensure the structural stability and integrity of the building or structure to which the Products (e.g., Balcony, Balustrade) will be attached.

  • Identification of Structural Defaults: If, during the installation process, our team identifies any defaults, weaknesses, or instabilities in the building's structure which couldn't be identified during the survey, and that prevent a safe and secure installation in accordance with standard building practices and our specifications, we will notify the Customer immediately.

  • Required Remedial Work: In such circumstances, any remedial work required to strengthen or rectify the structural issues to allow for a successful and safe installation will be the sole responsibility and cost of the Customer. We do not involve ourselves with third-party tradesmen and are not responsible for the work of others outside of our contract with you.

  • CSW Fabrications' Right to Charge: CSW Fabrications reserves the right to undertake or arrange for the necessary structural work if deemed essential for the safe installation of the Products. The costs for such work, as reasonably determined by CSW Fabrications, will be fully chargeable to the Customer. We will endeavour to provide an estimate for such work where possible, but the final charge will be based on the actual work required.

5. Installation Process

  • Our installation team will carry out the installation with reasonable skill and care, adhering to industry best practices and the agreed-upon specifications.

  • The Customer, or a designated representative, should be available at the installation site during the agreed-upon installation period to address any queries or provide necessary access.

6. Completion of Installation

  • Upon completion of the installation, our team will conduct a basic site clean-up, removing installation-related debris. However, comprehensive site cleaning remains the responsibility of the Customer.

  • The Customer will be asked to sign an installation completion form, acknowledging that the installation has been completed to a satisfactory standard (subject to any agreed-upon snagging items).

7. Warranty on Installation

Our installation services are covered by our Warranty, as provided prior to order, against defects in workmanship, as detailed in our main Warranty document. This warranty is contingent upon the Customer adhering to these Installation Terms and the conditions outlined in our overall Installation Terms and Conditions.

8. Limitation of Liability

We shall not be liable for any delays or additional costs arising from the Customer's failure to comply with these Installation Terms or any pre-existing structural issues with the installation site.

9. Governing Law

These Installation Terms shall be governed by and construed in accordance with the laws of England and Wales.

By proceeding with our installation services, you acknowledge that you have read, understood, and agree to these Installation Terms and Conditions.
